Terms of Service

Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using https://corebody.asia/ (“the Site”) operated by Core Wellness Sdn. Bhd, operating as CoreBody (“Company”, “us”, “we,” or “our”) and for participation in activities at our studios. This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://corebody.asia/ and for your participation in activities at our studios.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. By participating in any activities and usage of amenities in the Facility, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for use of the CoreBody’s services. You are only authorized to use the CoreBody’s services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully. If you do not agree with it, you should leave CoreBody website and discontinue use of CoreBody services immediately. If you wish to become a Member, you must read these Terms of Service and indicate your acceptance during the registration process.

1. General Membership Terms

1.1 Membership Access

Membership grants access to classes and facilities as per the selected membership package. CoreBody reserves the right to modify class schedules, instructors, and facilities without prior notice.

1.2 Compliance with Studio Policies

Members must adhere to all CoreBody studio policies, including class booking, hygiene standards, and facility usage guidelines. Failure to comply may result in suspension or termination of membership without refund.

1.3 Personal Responsibility

Members are responsible for their personal belongings. CoreBody is not liable for any lost, stolen, or damaged items within the premises.

2. Health and Safety

2.1 Medical Clearance

Members certify they are physically fit with no medical conditions preventing safe participation. CoreBody is not liable for health issues arising from participation.

2.2 Assumption of Risk

Participation in fitness activities involves inherent risks. By joining, members voluntarily assume these risks.

2.3 No Guarantee of Results

CoreBody does not guarantee specific fitness results; outcomes may vary between individuals.

3. Liability & Indemnification

3.1 Waiver of Claims

Members waive and release CoreBody from any claims arising out of participation in fitness activities or facility usage, to the fullest extent permitted by law.

3.2 Indemnification

Members agree to indemnify CoreBody against any claims, damages, or expenses arising from their actions or failure to comply with these terms.

3.3 Equipment Usage

CoreBody purchases and leases equipment from third parties and is not liable for defects or resulting injuries, loss, or damages.

3.4 Events Beyond Control

CoreBody shall not be held liable for failure to perform obligations due to events beyond its control, including but not limited to natural disasters, government restrictions, or other unforeseeable events.

4. Membership Suspension & Termination

4.1 Suspension Policy

We reserve the right to modify these Terms and Conditions by updating the terms on the Site at our sole discretion. Your continued use of the Site after any updates constitutes your acceptance of the new Terms and Conditions. We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement, or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

4.2 Termination for Non-Compliance

CoreBody reserves the right to terminate membership per membership term for non-compliance with policies or inappropriate behavior, without refund.

4.3 Non-Refund Policy

All membership packages, class credits, and promotional offers are non-refundable. No refunds or credits will be provided for unused or partially used memberships.

5. Payment Terms

5.1 Account Creation

Members must create an account before purchasing any packages. Purchases can be made online or directly at our studios. The package commences from the purchase date upon confirmation via email.

5.2 Payment for Package Sharing

Only selected packages are shareable among CoreBody members. Payment must be completed before the sharing process is executed.

6. Member Services & Policies

6.1 Class Cancellations

Class cancellations must be made via the registered account, phone call, or email. Late cancellations or no-shows will result in credit deduction without refund. A 12-hour cancellation period applies to all methods.

6.2 Class Reservations

All reservations must be made through the online booking system. Members must be physically present at least 5 minutes before class commencement. Late arrivals will be denied entry, and class credit will be deducted.

6.3 Waiting List

If a class is fully booked, members can join the waitlist. Those at the top of the waitlist and present at the studio may claim a spot if a reserved space is unclaimed 5 minutes before class starts. Credit is deducted only upon successful participation.

6.4 Personal Belongings

CoreBody is not responsible for the safekeeping of personal belongings. Members assume full responsibility and risk for their items.

7. Waiver & Release

The following Waiver & Release takes effect upon registering an account with CoreBody on our website.

In consideration of the services provided by Core Wellness Sdn Bhd, operating as CoreBody (“Company”), in relation to conducting and carrying out activities including any classes, programs, training, instruction, or events (“Activities”), and/or use of facilities or equipment therein (“Equipment”), whether provided by the Company, or otherwise, the Company’s employees, contractors, agents, affiliates, representatives, assigns, or successors (“Associates”), I, the undersigned, hereby voluntarily agree as follows:

Declaration:

  • I confirm that I am 18 years old or older to participate in the Activities. For ages 17 and under, parental/guardian supervision is required.
  • I declare that I am physically sound and free from any condition, impairment, disease, or illness that would prevent my participation in the Activities or use of the Equipment. If I have any medical concerns, I will seek professional medical advice before participating.
  • I acknowledge that Activities and the use of Equipment can be physically demanding and, if performed incorrectly, may cause serious harm. I assume full responsibility for my participation and actions.
  • I understand that CoreBody and its staff do not provide medical advice. It is my responsibility to assess my own health and fitness before engaging in any Activities or using the Equipment.
  • If I have any health concerns, I must consult a medical professional before participating. Any participation contrary to medical advice is at my own risk.
  • I understand that CoreBody and its staff are not liable for any medical decisions or assistance provided in the event of an accident or injury. I am responsible for securing personal health insurance if desired.
  • My access to the Activities is subject to availability and is not guaranteed at any specific time. CoreBody reserves the right to refuse entry or remove me from the premises if I:
    • Engage in actions that could cause damage to the Premises or Equipment.
    • Fail to follow instructions regarding safe use of the Equipment and participation in Activities.
    • Act in a manner that threatens, harms, or causes discomfort to staff or other members.
    • Appear to be under the influence of intoxicating or illicit substances.

Assumption of Risk:

  • I fully understand the inherent risks, dangers, and hazards associated with participating in Activities and using Equipment.
  • I acknowledge that it is my responsibility to undergo a physical examination and obtain medical clearance before participation.
  • I assume all risks of injury, illness, death, damage, or loss arising from my participation in Activities or use of Equipment, including risks due to negligence or equipment defects.
  • CoreBody is not responsible for any defects in third-party Equipment used at the Premises.
  • I am solely responsible for my personal belongings while at CoreBody, including items left in lockers.
  • On behalf of myself, my next of kin, heirs, personal representatives, and assigns, I release, indemnify, and hold harmless CoreBody, its employees, contractors, affiliates, and successors from any claims, damages, or liabilities arising from my participation in Activities or use of Equipment, to the fullest extent permitted by law.

8. Intellectual Property

8.1 Ownership of Content

The Site contains material such as software, text, graphics, images, designs, sound recordings, audiovisual works, and other materials provided by or on behalf of the Company (“Content”). The Content may be owned by the Company or authorized third parties.

8.2 Restrictions on Use

Any unauthorized use of the Content may violate copyright, trademark, and other laws. Posting or using the Content on other websites or in networked environments is strictly prohibited.

8.3 Trademarks and Logos

The trademarks, service marks, and logos used on the Site are registered and unregistered marks of the Company. Nothing on the Site shall be interpreted as granting any license or right to use these marks without the Company’s prior written permission for each specific use.

8.4 Reproduction and Distribution

No Content may be retransmitted, reproduced, or printed in any form (electronic or otherwise) without the Company’s express written consent for each instance.

9. Personal Data

9.1 Data Collection & Use

Members acknowledge that CoreBody collects, processes, and retains personal data in accordance with the Personal Data Protection Act 2010 and the Company’s Personal Data Policy.

9.2 Consent to Use of Data

By enrolling, members consent to the processing of personal data for administrative and marketing purposes.

10. Amendments to Terms & Conditions

10.1 Right to Amend

CoreBody reserves the right to amend these terms and conditions at any time. Members will be notified of significant changes through official communication channels.

11. Governing Law & Dispute Resolution

11.1 Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia and subject to the exclusive jurisdiction of Malaysian courts.

11.2 Dispute Resolution

Disputes should be resolved through negotiation; failing which, they may be referred to arbitration in Malaysia.

12. Acceptance of Terms

By enrolling, members confirm they have read, understood, and agree to these Terms and Conditions as a legally binding contract. Members confirm they are 18 years old or above or have obtained guardian consent where required.
